Washington Community Property
Just and equitable — with nothing off the table.
Among the six states on this platform, Washington alone puts SEPARATE property before the court: the statute reaches property 'either community or separate' when a just and equitable division requires it, misconduct-blind. Characterization still matters enormously — it shapes the equities — but untouchability is not the reason.
The standard — RCW 26.09.080
Washington disposes of property and liabilities — community AND separate — as appears just and equitable, without regard to misconduct (RCW 26.09.080). Characterization still matters enormously, but no category is untouchable: the four statutory factors, not a mechanical formula, drive the division.
Community defined — RCW 26.16.030
Property acquired after marriage or domestic-partnership registration that is not separate property is COMMUNITY property (RCW 26.16.030) — with the statute's own management-and-control limits on gifts, real-property conveyances, and household goods.
RCW 26.09.080(1)
The nature and extent of the community property
RCW 26.09.080(2)
The nature and extent of the separate property
RCW 26.09.080(3)
The duration of the marriage or domestic partnership
RCW 26.09.080(4)
Each party's economic circumstances when the division takes effect — including the desirability of awarding the family home (or the right to live in it) to the parent with whom the children reside the majority of the time
The characterizer
Add your items — when acquired, how acquired — and the organizer applies the statutory rules. Flags, never adjudication; everything stays on this device.
The organizer's read (0)
Add an item on the left — each gets the statutory rules applied, with the reason stated.
Characterization here is an organizer over the statutory rules — title form, tracing, commingling, and improvement claims can all move an item, the court can reach separate property when equity requires, and those are exactly the calls that deserve counsel.
