Summary charts & calculations
A chart, summary, or calculation standing in for voluminous underlying records — years of bank statements reduced to a page, a support arrears ledger, an income timeline. Section 90.956 permits exactly this, and attaches duties.
Wired to the law it implements
Retrieved live from the source-locked corpus — never generated.
“voluminous writings, recordings, or photographs, a party may present them in the form of a chart, summary, or calculation by calling a qualified witness.”The five gates, for this item type
Neutral education — each gate runs separately, and passing one is never presented as admissibility. The Five Gates page carries the full statutory walk.
- Relevance
The summary inherits its relevance from the underlying records — a chart of undisputed deposits commonly proves nothing anyone contests.
- Authentication
The statute's own mechanics: a qualified witness presents the summary, timely written notice is given with proof filed, and the underlying originals or duplicates stay available for examination.
- Hearsay
The summary is a vehicle — the underlying records still need their own lane (business records being the common one). A chart cannot launder inadmissible underlying data.
- Best evidence
Section 90.956 is Article X's own answer to volume — but the originals or duplicates of the data must be made available at a reasonable time and place, and a judge may order them produced in court.
- Privilege
A summary compiled from privileged material exposes the privilege problem it was built on — flag before building.
The organizer checklist
Generic, neutral, and yours to select from — organization, never legal acts. The Evidence Organizer is where the log lives.
- Build the chart FROM records you can produce — every line traceable to its source
- Give the written notice the statute requires, and keep proof it was filed
- Have the underlying records organized and available for the other side's examination
- Note who prepared the summary and how — the qualified witness presents it
- Keep the calculation reproducible: same inputs, same result, on request
Objections to expect — as education
- Summary without foundationThe objection says a chart or calculation is standing in for records the statute's duties never covered — no timely notice, no qualified witness, or underlying data never made available for examination..
- HearsayThe objection says the item is an out-of-court statement offered to prove what it asserts.
- Best evidenceThe objection says the contents of a writing, recording, or photograph are being proved without the original — the screenshot-versus-the-phone fight..
Getting this class of evidence INTO the case has its own rulebook — the Procedure Matrix maps disclosure, discovery, and the subpoena to the family rules that govern them.
Where this page stops
Whether YOUR summary charts & calculations clear these gates depends on facts and foundations this page cannot see and will not guess. Independent attorney review is the route for judgment.
